Come out and show your support for Ed as the judge decides
what to do with the many witnesses who have refused to testify
against him. What evidence the jury will get to hear this
time will also be considered.
The government has subpoenaed more than 70 witnesses to testify
against Ed, even though prosecutors have acknowledged that
they can get no additional jail time or fines if they again
convict him, since he has already served his sentence.
Nearly a dozen of those witnesses have indicated that they
will refuse to testify if called, even if ordered to do so
under an immunity agreement with the court. At last week’s
hearing, the judge said he to hold them in contempt but noted
that he can only jail or fine them if the penalty is likely
to produce testimony.

The hearing tomorrow will also take up the question of what
the jurors will be entitled to know about the case. The prosecutor
had said he wanted to convict Ed again with a jury that heard
all the evidence, but in papers filed with the court he made
it clear that the government is going to attempt to keep the
whole truth from them again but preventing any mention of
the City of Oakland program that deputized Ed to cultivate
medical marijuana for patients.
Following Ed’s January 2003 conviction, jurors in the case
publicly recanted their verdict and leveled harsh criticism
at the government for withholding information about the Oakland
program.
